1. Who you are contracting with

This website is operated by Alain Philippe, Rue du Rhône 90, 1204 Geneva, Switzerland. In these terms, "we", "us" and "our" mean Alain Philippe, and "you" means the person placing an order.

2. These terms

These terms apply to every order placed through this website. Please read them before you order. By placing an order you accept them.

We may amend these terms. The terms that apply to your order are those published on this website at the moment your order is placed, and we will hold a copy for you on request.

3. The pieces

Our pieces are made by hand and set with natural stones. Colour, inclusion, matching and figure vary between individual stones, and a photograph on this website is a representation of a piece rather than a record of the individual piece you will receive. A screen will also render a piece differently from one device to another. Where a piece is unique, we say so on its page.

Weights, measurements and stone counts given on this website are those recorded for the piece and are given in good faith. Where a piece is one of several made to the same reference, the figures are those of the reference.

We may change the description of a piece, and we may withdraw a piece, at any time.

4. Availability

Many of our pieces exist in a single example, and a piece shown on this website may be sold or reserved between the moment you place an order and the moment we accept it. Where that happens we will tell you, and we will refund you in full.

5. Orders and acceptance

Your order is an offer to buy. A contract is formed when we send you written confirmation that your order has been accepted, and not when you place it, and not when a payment is authorised or taken.

We may decline an order. We will do so where the piece is no longer available, where a price or description has been published in error, where we are unable to complete the checks in section 7, where we are not able to deliver to the address given, or where delivery would breach a restriction we are required to observe.

Please review your order before you submit it. We may be unable to accommodate a cancellation once an order has been accepted.

6. Price and payment

Prices are shown in United States dollars. Unless we expressly state otherwise, the price shown does not include tax, delivery, handling, customs, insurance or import charges. Delivery charges and import duty are dealt with in the shipping policy.

The price charged is the price in effect when the order is placed, and it is set out in your order confirmation. Prices are subject to change without notice.

Where a price has been published in error and the error is one you could reasonably have recognised, we are not obliged to sell at that price, and we will tell you and allow you to confirm the order at the correct price or to cancel it.

Payment is taken in full before dispatch, by the methods offered at checkout. You confirm that you are authorised to use the payment method you give us, and that the details you give us are correct and complete.

7. Verification

Because of the value of our pieces we carry out identity, payment and source of funds checks before we accept an order, and we are required by law to carry out some of them. We may ask you for documents in support. Where we are unable to complete these checks we will decline the order and refund any sum taken, and we may not be able to tell you why.

8. Title and risk

Risk in a piece passes to you on delivery, as set out in the shipping policy. Title in a piece passes to you when we have received payment in full and the piece has been delivered, whichever is the later.

10. Returns and exchanges

The returns and exchanges policy forms part of these terms. It sets out that we do not issue monetary refunds or credit notes, that an exchange is considered case by case and granted at our discretion, and that a refund is made where the law of the country in which you live requires one.

11. Guarantee and repairs

Every piece is supplied with its guarantee document, and the terms of that document apply to it.

Where a piece needs repair, write to us before you send it, and we will tell you what the assessment involves and how to send the piece to us.

Your rights under the law of the country in which you live are not affected by these terms.

12. Your account and your conduct

Where you hold an account with us, keep your credentials to yourself and tell us if you believe they have been used by another person. You may not transfer, sell or assign your account to another person.

You may not use this website to place an order in a false name, on behalf of an undisclosed person, or for resale without our written agreement.

13. Intellectual property

The name Alain Philippe, our marks, our designs, and the photographs, text and layout of this website belong to us or are used by us under licence. You may not reproduce them, in whole or in part, without our written permission.

14. Liability

We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or of our failing to use reasonable care. We are not responsible for loss that is not foreseeable, and we do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit.

We are not responsible for a loss caused by this website being unavailable, by a technical failure, or by a message to or from us being delayed or not received.

15. Governing law and jurisdiction

These terms, and every transaction made under them, are governed by Swiss law, and a dispute is subject to the jurisdiction of the courts of Geneva, Switzerland. Where you buy as a consumer, the mandatory consumer protection law of the country in which you live, and your right to bring proceedings there, are unaffected.

16. Events outside our control

Where we are prevented from performing an accepted order by an event outside our reasonable control, we will tell you and we will agree with you whether to extend the time for delivery or to cancel and refund.
